These Terms and Conditions (“Terms”) apply when you use this website or purchase, access or participate in products or services offered by Jo Kendall / JO KENDALL PTY LTD, including digital resources, workshops, programs and other online offerings.

Separate agreements may apply to particular services, including private 1:1 therapy or somatic work and particular programs.

Where a separate written service agreement applies, that agreement will govern the specific service and these Terms will continue to apply to the website and other matters not addressed in that agreement.

By using this website or purchasing a product or service, you agree to these Terms.

Information on this website is provided for general educational and informational purposes unless expressly stated otherwise.

Reading the website, joining an email list, downloading a free resource or following Jo Kendall on social media does not create a therapist-client relationship.

A therapeutic or professional relationship begins only where this is expressly agreed through the relevant service process or written agreement.

4. Health and wellbeing information

General website content, social-media content, emails, podcasts, workshops and self-guided digital resources are not intended to provide individual diagnosis, emergency care or personalised medical advice.

They are not a substitute for medical, psychological, psychiatric or other individual health care where this is required.

Nervous-system education describes general concepts and does not mean that a particular behaviour, symptom or experience has the same cause for every person.

You remain responsible for deciding whether a general resource or program is appropriate for your circumstances and for seeking appropriate individual support where needed.

5. Emergency and crisis support

Jo Kendall’s website, email, programs, digital resources and ordinary communication channels are not emergency or crisis services and may not be monitored continuously.

If you are in immediate danger or require urgent assistance in Australia, call 000.

For crisis support in Australia, Lifeline can be contacted on 13 11 14.

If you are outside Australia, contact the appropriate emergency or crisis service where you are located.

6. 1:1 services

Private 1:1 services may involve therapy, somatic practice, coaching or other agreed forms of support depending on the specific service and professional scope.

The exact nature, frequency, inclusions, fees, confidentiality arrangements, cancellation terms and scope of 1:1 work will be provided before services begin and may be governed by a separate client agreement or informed-consent document.

Current 1:1 options may include three, six or twelve-month containers, where offered.

Submission of an enquiry does not guarantee acceptance as a client.

7. Nervous System First and other programs

Program details, inclusions, duration, access, live components, pricing and eligibility will be described on the applicable sales or information page.

Nervous System First is currently designed as a six-month, deliberately paced program.

Where program content includes education, group practices, community support or other experiential work, participation does not guarantee any particular personal, therapeutic, relationship, health or financial outcome.

Any therapeutic component will be provided only within the professional scope and terms expressly communicated for that offering.

8. Digital resources and The Practice of You Shop

Digital resources may include guides, audio practices, workshops, recordings, email series, mini-programs, templates or other educational materials.

Unless otherwise stated, purchases are for your personal use only.

You may not reproduce, distribute, resell, publish, share login details for, upload, teach from or commercially exploit purchased materials without written permission.

9. Orders and payment

Prices are displayed in Australian dollars unless otherwise stated.

You agree to provide accurate payment and billing information.

Payment may be processed through a third-party payment provider. I do not generally receive or store your full credit-card details.

Where GST applies, pricing will be handled as stated at checkout.

Your place in a paid service or program is not confirmed until required payment has been received or an agreed payment arrangement has been established.

10. Payment plans

Where a payment plan is offered, it is a payment arrangement for the full purchase price and is not automatically a month-to-month subscription that may be cancelled at any time.

By choosing a payment plan, you agree to make each scheduled payment unless the applicable offer terms or Australian Consumer Law provide otherwise.

If a payment fails, I may contact you to arrange payment and may pause access to paid materials or services where lawful and reasonable to do so.

11. Refunds and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where Australian Consumer Law gives you a right to a refund, cancellation, re-supply or another remedy, those rights continue to apply.

For change-of-mind purchases, refunds are not automatically provided unless a particular offer states otherwise.

Any additional voluntary refund policy for a specific product, program or service will be stated on its purchase page or client agreement.

12. Digital product refunds

Because digital products may be supplied immediately after purchase, change-of-mind refunds are generally not offered once digital content has been delivered or accessed, unless:

  • the applicable product page states otherwise; or

  • you are entitled to a remedy under Australian Consumer Law.

If something you purchase is faulty, inaccessible or materially different from what was described, please contact me so I can review the issue.

13. Program withdrawal or cancellation

If you choose to leave a program after joining, the financial and access consequences will depend on the terms provided for that specific program.

For Nervous System First, the current withdrawal policy is:

14. 1:1 cancellations and rescheduling

Private-session cancellation and rescheduling terms will be provided in your client agreement.

Current cancellation period:

Late cancellations or missed sessions may be charged or treated as used except where otherwise agreed, required by law or appropriate in exceptional circumstances.

15. Results and outcomes

I care deeply about providing thoughtful, high-quality work.

However, no particular outcome can be guaranteed.

Human behaviour, mental and emotional wellbeing, relationships, nervous-system responses, business, work and life circumstances are individual and influenced by many factors.

Testimonials, examples and case studies describe individual experiences and should not be interpreted as guarantees that you will experience the same result.

16. Your participation and responsibility

Where you participate in a program, practice, resource or service, you are responsible for deciding whether and how to engage with the material.

You are encouraged to work at a pace appropriate to your circumstances and to stop a practice and seek individual support if you experience significant distress or have concerns about your physical or psychological wellbeing.

You remain responsible for decisions you make in your relationships, health, work, business, finances and life.

17. Community spaces

If a program includes a private group or community, you agree to interact respectfully and to protect the privacy of other participants.

You must not copy, record, screenshot, publish or share another participant’s personal information, story or contribution outside the community without their express permission.

I may remove content or revoke community access where reasonably necessary to protect participants, maintain boundaries or address harmful or inappropriate conduct.

18. Intellectual property

Unless otherwise stated, website content, written material, program content, teaching material, videos, audio, graphics, downloads, frameworks, practices and other original material are owned by or licensed to Jo Kendall.

Purchasing or accessing material gives you a limited, personal, non-exclusive licence to use it for its intended personal purpose.

It does not transfer ownership or give permission to copy, reproduce, sell, distribute or commercially use the material.

19. Website use

You agree not to use this website:

  • unlawfully

  • to interfere with its security or operation

  • to attempt unauthorised access to systems or accounts

  • to copy or exploit content in breach of intellectual-property rights

  • to submit malicious code, spam or harmful material.

20. Third-party services and links

This website and my services may link to or use third-party providers, including website hosts, payment processors, email providers, booking platforms and social-media services.

Those providers have their own terms, policies and availability.

While I choose service providers with care, I do not control third-party systems and cannot guarantee uninterrupted availability of those systems.

21. Availability and changes

I may update, improve or change website content, products or program materials from time to time.

Where you have already purchased a particular product or program, I will not intentionally remove the core service or access you purchased without a reasonable basis or suitable alternative, subject to these Terms and applicable law.

Live-session times or minor program logistics may occasionally need to change. Where this occurs, reasonable notice will be provided where practicable.

22. Liability

Nothing in these Terms excludes liability or rights that cannot legally be excluded.

To the maximum extent permitted by law, I am not responsible for indirect or consequential loss arising solely from use of general website information, free content or self-directed resources.

Where liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.

23. Privacy

Your personal information is handled in accordance with my Privacy Policy and applicable privacy law.

24. Changes to these Terms

I may update these Terms from time to time.

The version published on this website at the time of your purchase will generally apply to that purchase, together with any specific terms you agreed to when purchasing or joining.

The latest website Terms will display the date they were updated.

25. Governing law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.

Nothing in this clause limits any rights you may have under mandatory consumer-protection laws.
