This Privacy Policy explains how Jo Kendall / JO KENDALL PTY LTD (“Jo Kendall”, “I”, “me”, “my”) collects, holds, uses and discloses personal information when you visit this website, join my email list, enquire about working together, purchase a resource or program, or receive services from me.

I aim to handle personal and health information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and Australian Privacy Principles, and where applicable the Health Records and Information Privacy Act 2002 (NSW) and Health Privacy Principles.

2. Information I may collect

Depending on how you interact with me, I may collect information including:

  • your name, email address, phone number and location

  • information you provide through enquiry, contact, registration or intake forms

  • information you share in emails, direct messages, calls, sessions or program spaces

  • billing and transaction information

  • information about products, programs or services you have purchased or joined

  • marketing preferences and email subscription information

  • website usage information, such as device, browser, pages visited and similar analytics information

  • health or wellbeing information you choose to provide when enquiring about or receiving a health-related service

  • notes and records reasonably necessary to provide 1:1 therapeutic or somatic services

  • other information you voluntarily provide.

Information collected while providing a health service may constitute health information and sensitive information under Australian privacy law.

3. How I collect information

I generally collect personal information directly from you, including when you:

  • complete a website, enquiry, intake or checkout form

  • subscribe to the Free 7 Day Series or another email resource

  • purchase a digital resource or program

  • enquire about or receive 1:1 services

  • communicate with me by email, direct message, video call or other communication channel

  • participate in a program, community, workshop or live experience.

Some information may also be collected automatically through website hosting, cookies, analytics and similar technologies.

Where sensitive or health information is collected, I will only collect information that is reasonably necessary for the service being provided and where I have your consent or another lawful basis to collect it.

4. Why I collect and use your information

I may collect, hold and use your personal information to:

  • respond to enquiries and communicate with you

  • assess whether a service or program may be appropriate for you

  • provide therapy, somatic support, programs, digital resources and other services you request

  • administer bookings, payments and accounts

  • deliver purchased or subscribed content

  • maintain appropriate professional and service records

  • provide customer support

  • operate, secure and improve my website and services

  • send emails or marketing communications where you have consented to receive them

  • meet legal, professional, insurance, accounting and regulatory obligations

  • manage complaints, disputes or safety concerns.

I will not use health information for unrelated marketing purposes without appropriate consent.

5. Email and marketing communications

If you subscribe to my email list, Free 7-Day Series or another marketing resource, I may send you emails about my work, resources, programs, services and related content where I have your consent or another lawful basis to do so.

You can unsubscribe at any time using the unsubscribe link in an email or by contacting me.

Australian spam laws require commercial electronic messages to be sent with appropriate consent, identify the sender and provide a functioning unsubscribe method. ACMA

Unsubscribing from marketing does not prevent me from sending you necessary service-related communications relating to something you have purchased, booked or joined.

6. Who I may share information with

I do not sell your personal information.

I may disclose information where reasonably necessary to service providers who help me operate the business, such as:

  • Squarespace, which hosts this website

  • Kit, which I use for email communication and email sequences

  • payment processors

  • booking and scheduling providers

  • video conferencing platforms

  • cloud storage and business administration providers

  • accountants, insurers, lawyers or professional advisers

  • contractors who require access to information to provide an authorised service

  • regulators, courts, emergency services or other authorities where disclosure is required or authorised by law.

Service providers may only receive the information reasonably necessary for the relevant purpose.

7. Overseas processing and storage

Some of the technology providers I use process or store information outside Australia.

For example, Squarespace stores website data in the United States and may process information globally, and Kit is based in the United States and uses service providers that process information in the United States and other countries. Squarespace Help

This means personal information may be processed in jurisdictions including the United States and potentially other countries in which my technology providers or their subprocessors operate.

Where Australian privacy law applies, I take reasonable steps appropriate to the circumstances when using overseas service providers and handling cross-border disclosures.

8. Cookies and website analytics

This website may use cookies and similar technologies that help the site function, remember preferences and provide information about how visitors use the website.

Squarespace and other connected tools may also place cookies or similar technologies.

You may be able to manage cookies through your browser or through any cookie controls displayed on this website.

9. How information is stored and protected

I take reasonable steps to protect personal and health information from misuse, interference, loss and unauthorised access, modification or disclosure.

Depending on the type of information, this may include using password-protected systems, reputable third-party service providers, access controls, secure devices and appropriate record-management practices.

No method of internet transmission or electronic storage can be guaranteed to be completely secure.

10. How long I keep information

I retain information only for as long as reasonably necessary for the purpose for which it was collected, or as required by applicable law, professional obligations, insurance requirements or record-retention rules.

For health information subject to NSW private health provider requirements, current NSW guidance requires health information collected from an adult to generally be retained for 7 years from the last occasion a health service was provided. Where health information was collected when a person was under 18, records generally need to be retained until that person reaches 25 years of age. IPC NSW

When information is no longer required and may lawfully be destroyed, I take reasonable steps to securely destroy or de-identify it.

11. Accessing or correcting your information

You may contact me to request access to personal information I hold about you, or to ask for information to be corrected if it is inaccurate, incomplete or out of date.

There may be limited circumstances in which access cannot be provided, including where permitted or required by law.

12. Deletion requests

You may ask me to delete personal information.

In some circumstances I may be legally or professionally required to retain particular records, including health or financial records, even if deletion is requested.

Where deletion is not possible, I will explain this where appropriate.
